Naturalizing or obtaining U.S. citizenship has many advantages, such as voting in federal elections to obtaining a U.S. passport. Also, Lawful Permanent Residents (“Green Card holders”) will no longer have to renew their Green Cards or apply for re-entry permits for extended travel abroad.

Our office has assisted many individuals with the naturalization process. Here are TEN (10) tips to ensure that your naturalization application will be approved.

1. Complete the N-400 application completely and accurately – Mistakes can lead to a finding of material misrepresentation – even if you did not intend to deceive the United States and Immigration Services (USCIS). Material misrepresentation is a reason for the denial of the naturalization application. An attorney can ensure that the information is correct and help you find missing/incomplete information.
2. Apply when the time is right – Ensure that you qualify. Certain individuals can apply to become a U.S. citizen within THREE (3) years, while others must wait FIVE (5) years. In addition, there are physical and continuous residency requirements for every applicant. Please speak to an immigration attorney to ensure that you have met these requirements.
3. Memorize the civics questions (U.S. history and government) – Applicants must be able to answer SIX (6) out of TEN (10) questions correctly to pass the civics portion of the naturalization exam. The test changes periodically, so it is important that you obtain the most up-to-date edition.
4. Take an English or English as a Second Language (ESL) course to better your speaking and writing ability – There are many non-profit organizations that can assist foreign nationals speak and write English more proficiently. Learning the English language takes time and dedication. However, with hard work anything is possible.
5. Maintain a clean criminal record – Certain crimes, such as traffic tickets that do not involve alcohol or personal/property damage will not usually impact your naturalization case. This being said, there are certain crimes (i.e. crimes committed as a juvenile, petty theft, drug possession of marijuana that is less than 30 grams, etc.) may be excusable. Regardless of what crimes you have committed, police records, court records, or clearance letters may be required as part of your application. It is best to speak to a knowledgeable immigration to determine which documents are required.
6. Pay taxes – Failing to pay IRS taxes may lead to citizenship denial. If you have failed to pay taxes or owe taxes, speak to an immigration attorney to determine what steps you need to take in order to obtain your citizenship.
7. Pay child support – Failing to pay child support may lead to citizenship denial. If you have child support arrears (past due child support), speak to an immigration attorney to determine what steps you need to take in order to obtain your citizenship.
8. Submit the required documents – All naturalization applicants must be able to show that they are: (i) at least 18-years-old; (ii) a Green Card holder for the required number of years; (iii) a resident in the state or USCIS district where they are applying; (iv) compliant with the continuous and physical presence requirements preceding the date of filing; (v) able to read, write, and speak basic English; (vi) able to understand U.S. history and government (civics); (vii) a person of good moral character; and (viii) attached to the principles and ideals of the U.S. Constitution.
9. Attend a mock naturalization interview – If you have an attorney, ask your attorney to provide you with a mock or sample interview. This will ensure that you know what to expect during your naturalization interview. Our office provides a free and courtesy mock interview to all of our clients, who are applying for naturalization. 10. Understand your responses to the questions asked on the N-400 application – In addition to the civic questions, applicants must be able to understand the questions on the naturalization application. Many applicants will answer “yes” or “no” to certain questions without understanding what the question is asking. Having an attorney will ensure that you are prepared for any and all questions that may be asked of you during the naturalization exam.
